Belly Affairs Cuisine – Vendor Terms and Conditions

Effective Date: April 5th 2025.

These Vendor Terms and Conditions (“Terms”) govern the use of the Belly Affairs Cuisine platform by chefs (“Vendors”) who wish to list and sell food on the Belly Affairs Cuisine marketplace. By registering as a Vendor, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use the platform.

1. Vendor Registration

1.1 Eligibility: To become a Vendor on Belly Affairs Cuisine, you must be at least 18 years old and legally capable of entering into binding contracts.

1.2 Account Creation: You must create an account by providing accurate and complete information during the registration process.

1.3 Verification: Belly Affairs Cuisine may verify your identity and other details to ensure that you meet the required standards for selling food.

2. Listing of Products

2.1 Product Approval: You must list food products that comply with local health and safety regulations. Belly Affairs Cuisine reserves the right to reject or remove any product listing that does not meet these standards.

2.2 Food Categories: You are responsible for categorizing your food offerings appropriately to ensure that customers can find your products easily.

2.3 Accurate Description: All food listings must include accurate descriptions, prices, ingredients, and any relevant dietary information (e.g., allergens).

2.4 Product Availability: You must update product availability regularly. If you are unable to fulfill orders due to stock or capacity issues, you must remove or temporarily disable the affected listings.

3. Pricing and Payment

3.1 Pricing: You are responsible for setting the price of your products. Belly Affairs Cuisine may charge a commission fee for each sale made through the platform.

3.2 Payment Process: Payments for orders will be processed through the platform’s payment gateway. You will receive payments according to the platform’s payout schedule.

3.3 Refunds and Disputes: In the event of an issue with an order (e.g., food quality, delivery delays), you may be required to issue a refund or offer a replacement meal to the customer.

4. Quality Standards and Food Safety

4.1 Food Safety: You are responsible for ensuring that all food products comply with local health regulations, including food safety and hygiene standards.

4.2 Packaging: Food must be appropriately packaged to maintain quality and prevent contamination during delivery.

4.3 Inspection: Belly Affairs Cuisine reserves the right to conduct random inspections of your food, kitchen, and practices to ensure compliance with these standards.

5. Customer Service

5.1 Communication with Customers: You must respond to customer inquiries and concerns promptly and professionally.

5.2 Delivery: You are responsible for timely and accurate delivery of food orders to customers. You must ensure that food arrives in a safe and satisfactory condition.

5.3 Order Cancellations: If you are unable to fulfill an order for any reason, you must notify the customer and cancel the order immediately. You may also need to provide a full refund.

6. Platform Fees and Commissions

6.1 Fees: Belly Affairs Cuisine may charge a commission fee for each order processed through the platform. These fees will be clearly stated on your Vendor Dashboard. 6.2 Payment Schedule: Payments for orders will be made according to the payout schedule set by Belly Affairs Cuisine.

7. Vendor Obligations

7.1 Compliance: You must comply with all applicable laws, including food safety regulations, health standards, and licensing requirements.

7.2 Updates: You must keep your product listings and contact information up to date at all times.

7.3 Respectful Conduct: You agree to interact with customers, the platform, and other Vendors in a respectful and professional manner at all times.

8. Liability and Indemnification

8.1 Indemnification: You agree to indemnify, defend, and hold Belly Affairs Cuisine harmless from any claims, damages, or liabilities arising out of your use of the platform, including but not limited to food safety violations, delivery issues, or disputes with customers.

8.2 Liability: Belly Affairs Cuisine is not responsible for any issues or damages arising from food quality, safety, delivery, or any other aspect of your business.

9. Termination

9.1 Termination by Belly Affairs Cuisine: Belly Affairs Cuisine reserves the right to suspend or terminate your Vendor account at any time if you violate these Terms or if you engage in illegal or harmful activities.

9.2 Termination by Vendor: You may terminate your Vendor account at any time by notifying Belly Affairs Cuisine in writing. However, any outstanding obligations (e.g., pending orders, payments) must be fulfilled before account termination.

10. Modifications

10.1 Changes to Terms: Belly Affairs Cuisine may update or modify these Terms from time to time. You will be notified of any material changes, and continued use of the platform will signify your acceptance of the new Terms.

11. Governing Law

11.1 Applicable Law: These Terms shall be governed by and construed in accordance with the laws of Nigeria.
